FlashData Terms of Service

These Terms of Service ("Terms") are a contract between you and FlashData for use of the FlashData website, console, and data API (the "Service").

By creating an account, checking acceptance, or calling the API you agree to these Terms and the Privacy Policy. If you use the Service for an organization, you represent that you can bind that organization.

FlashData provides a metered developer API and console for querying supported data sources, including Google search-style results via upstream providers and YouTube metadata, search, transcripts, and downloads where enabled.

The Service is provided on a commercially reasonable basis. Features may be gated, rate-limited, or unavailable. Preview, test, and sandbox deployments may change without notice.

Results come from third-party sources. We do not guarantee completeness, accuracy, legality, or continued availability of any upstream index, video, or page.

You must provide an accurate email and keep credentials confidential. You are responsible for all activity under your account and API keys.

API keys are shown in plaintext only once. Revoke a key immediately if it is leaked. Do not embed live keys in public client-side code.

We may lock, restrict, or close an account that appears compromised, abusive, or in violation of these Terms.

You may only use the Service for lawful purposes and in accordance with each upstream provider's terms (including Google, Serper, YouTube, and yt-dlp related source rules).

You must not: attack or overload the Service; bypass billing, quotas, or authentication; resell raw access in a way that conceals FlashData as the origin without permission; scrape FlashData itself; submit malware; or use the Service to infringe intellectual property or privacy rights.

You are solely responsible for the queries you send, the destinations you configure, and how you store or publish results.

Paid plans, top-ups, and usage are priced in US dollars. Checkout and the customer portal are hosted by Stripe. Taxes may be added by Stripe where required.

Credits are a metering unit for API usage, not cash, not a stored-value account, and not transferable. Unused subscription credits do not survive cancellation unless a specific grant says otherwise.

Failed queries are not charged. Successful metered usage, including download bytes where applicable, is settled according to the published catalog. We do not provide local refund buttons; refunds and disputes are handled through Stripe and may reverse previously granted credits.

Test-mode Stripe payments on preview environments are not live charges. Live prices apply only when the Service is running in Stripe live mode.

You retain rights in the queries, destination configurations, and other content you submit. You grant us a limited license to process that content solely to provide and secure the Service.

FlashData, the console, documentation, and software remain our intellectual property. We grant you a non-exclusive, revocable license to use the Service during a valid subscription or PAYG balance.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation.

To the maximum extent permitted by law, FlashData is not liable for lost profits, lost data, indirect or consequential damages, or upstream provider outages. Our total liability for any claim relating to the Service is limited to the fees you paid to FlashData in the three months before the claim.

Some jurisdictions do not allow certain limitations. In those cases the limitation applies to the fullest extent allowed.

You may stop using the Service and request account deletion in the console. Deletion follows a grace period and then removes or anonymizes account data as described in the Privacy Policy.

We may suspend or terminate access immediately for non-payment, abuse, legal risk, or operational emergency. Outstanding fees remain due.

These Terms are governed by the laws of the United States, excluding conflict-of-law rules. If a dispute cannot be resolved informally, the courts of the United States shall have exclusive jurisdiction, except where applicable consumer law requires otherwise.

If a provision is unenforceable, the rest remains in effect. These Terms and the Privacy Policy are the entire agreement for the Service.
